Regulations on Disciplinary Violations for International Students of JSCC

In order to strengthen the school discipline, maintain the normal teaching and living order, and create a good learning and living environment, these regulations are formulated in accordance with the relevant laws, regulations and ordinances issued by the Ministry of Education of the People's Republic of China, such as the Regulations on the Administration of Students in General Institutions of Higher Education, the Management Measures for Enrollment and Cultivation of International Students, and the Regulations on Disciplinary Violations for Students of Jiangsu Urban and Rural Construction Vocational College, as well as the actual situation of the school.

Chapter I General Provisions

Article 1 These regulations are applicable to international students of all levels registered in the college. 

Article 2 The college safeguards the legal rights and interests of students, and international students have the obligation to abide by the laws and regulations and the management regulations of the college.

Article 3 The college has the right to criticize, educate or discipline the international students who have violated the law, rules or discipline (hereinafter referred to as discipline), and it is the warning and correction of the international students who deviate from the basic moral behavior.

Article 4 The college shall impose disciplinary punishment on students who have violated discipline in a proper procedure, with sufficient evidence, clear basis, accurate characterization and appropriate punishment.

Chapter II Types, authority and application of disciplinary treatment

Article 5 The basic ways of disciplinary treatment for international students include: reminding talk, notification and criticism, fault record and disciplinary punishment. Disciplinary punishment is divided into warning, serious warning, demerit, probation and expulsion. The reminding talk, notification and criticism and fault record are not disciplinary punishment.

Article 6 The authority of the college to deal with discipline of international students shall be carried out according to the following regulations.

(1) The international students who violate the rules will be reminded by their second-level schools.

(2) The notification and criticism are divided into school and college levels, and the authority to deal with them lies with the second-level schools and the Student Affairs Office respectively. The decision of handling the notification and criticism will be announced in the second-level schools or within the college.

(3) If the decision of handling the disciplinary student's fault record is made, the second-level school will propose the handling opinion. Disciplinary punishment shall be imposed if the total number of fault records is more than three times.

(4) The second-level schools shall put forward their opinions on the disciplinary measures of warning, serious warning and demerit for international students who have violated the discipline, and be responsible for issuing documents and countersigning by the Student Affairs Office. If the disciplinary punishments for international students involve two or more second-level schools, the Student Affairs Office can make the punishment directly after coordinating the opinions.

(5) If a disciplinary sanction of probation is imposed on an international student, the relevant second-level school shall study it and the Student Affairs Office shall propose the treatment and submit it to the head of the college for approval. If a disciplinary sanction of expulsion is imposed on an international student, the Student Affairs Office shall submit a handling opinion and the President's office meeting shall decide. The decision of expulsion shall be reported to the higher education administration department and public security department by the the Student Affairs Office for record.

Article 7 International students who violate discipline may be mitigated, reduced or exempted from punishment or treatment in any of the following circumstances:

(1) They can admit their mistakes voluntarily and have a good attitude of admitting their mistakes.

(2) Students can report other disciplinary violations that are proven to be true.

(3) Students take the initiative to report and expose other people's disciplinary behavior and actively assist the Student Affairs Office in investigating and handling problems.

(4)Students are indeed coerced by others, lured or the circumstances are particularly minor.  

(5) Those who make mistakes occasionally and the circumstances are minor and corrected after criticism and education.

Article 8 The disciplinary student shall be treated more seriously or aggravated if he/she has any of the following circumstances:

(1) Those who refuse to admit their mistakes, have a bad attitude or deliberately conceal important circumstances.

(2) Those who have two or more disciplinary behaviors.

(3) Organizers and instigators of mass disciplinary incidents.

(4) Those who threaten or retaliate against informants or witnesses after committing a disciplinary offence

(5) Those who collude with people outside the school to violate discipline (including brawling, stealing, extortion, alcoholism and nuisance, etc.).

Chapter II Disciplinary Violations and Corresponding Treatment

Article 9 Anyone who violates Chinese laws and constitutes a criminal offense shall be given the punishment of expulsion from school. Those who are punished for violating public security regulations and are of bad nature shall be given expulsion from school; other violations of public security regulations shall be punished with a demerit or probation depending on the seriousness of the case.

Article 10 Those who organize and incite disturbances, disrupt stability and unity, and disturb social order shall be punished by expulsion from school; those who organize and set up illegal organizations or plan and organize large-scale rallies, marches and demonstrations without the approval of relevant departments shall be punished by expulsion from school; those who participate in illegal organizations, rallies, marches and demonstrations shall be punished by criticism and education or warning, depending on the seriousness of the circumstances.

Article 11 International students who violate school management regulations, affect the order of education and teaching, the order of life and the order of management of public places, and infringe on the legitimate rights and interests of other individuals and organizations, and have not yet constituted a crime, shall be given the following penalties depending on the circumstances and consequences.

(1) Violation of school regulations, affecting the order of education and teaching, order of life and management of public places, infringing on the legitimate rights and interests of other individuals and organizations, shall be given a warning, a serious warning or a demerit. If the situation and consequences are serious, the student shall be placed on probation or expelled from school;

(2) If the student obstructs state employees or school administrators in the performance of their official duties in accordance with the law or school rules and regulations, he/she shall be given a warning up to probation depending on the circumstances and severity of the consequences;

(3) Whoever deliberately destroys public facilities, damages the property of schools or others, uses electricity, fire or other dangerous objects in violation of regulations, causing consequences, in addition to compensating for economic losses, shall be given a serious warning or demerit punishment;

(4) Serious warning or demerit for hooliganism such as sexual harassment, drunkenness, gambling or providing conditions for gambling;

(5) A serious warning or demerit for distributing or copying illegal books or audiovisual products, participating in illegal pyramid schemes or conducting religious activities on campus;

(6) Those who insult, slander, falsely accuse, frame or threaten others and violate the freedom of communication of others shall be given a warning, a serious warning or a demerit.

Article 12 International students who violate the rules of dormitory management shall be dealt with according to the circumstances.

(1) Those who change or occupy student dormitories without permission and do not correct themselves after advice or criticism and education shall be given a serious warning;

(2)  Students who do not return to school at night without permission will be given a serious warning; those who stay in school or dormitory without permission will be given a warning, and those who cause adverse consequences will be given a warning or more.

(3) Those who stay overnight in dormitories of the opposite sex or let the opposite sex stay overnight will be given a demerit depending on the circumstances. If the conduct and circumstances are serious and cause extremely bad influence, the student may be placed on probation or above.

(4) Those who use all kinds of electrical appliances in violation of regulations shall be confiscated and given a warning sanction; repeat offender who use electricity in violation of regulations shall be given a punishment of demerit. Those who use electrical appliances or open fires in violation of regulations, causing fire alarms or fires, in addition to financial compensation, shall be punished with demerit and probation according to the circumstances; those who cause serious losses and harm shall be expelled from school;

(5) Those who do not take the initiative to swipe the campus card when entering or leaving the dormitory through the access control system or deliberately do not swipe the card after being reminded by the management staff will be given a warning or above, and those who cause adverse consequences will be given a demerit or above.

(6) Keeping pets in the student apartment (dormitory) will be punished with a warning if the student does not correct the situation after education.

Article 13 For theft, fraud and extortion of other people's property, depending on the value of the crime, the number of times, the means and the circumstances of the confession and refund, the following penalties shall be imposed respectively:

(1) If the amount of the crime is less than 500 yuan, a warning or serious warning shall be given depending on the circumstances;

(2) If the amount of the crime is more than 500 yuan and does not constitute a crime, the student shall be punished with a demerit or probation depending on the seriousness of the case;

(3) Repeated theft or fraud, which has not yet constituted a crime, will be punished by probation or expulsion from school.  

(4) Those who provide information or tools for theft, fraud or robbery, or those who assist in the concealment, sale or distribution of stolen goods, or those who knowingly fail to report, shall be punished with a demerit or above.

Article 14 The international students who violate the relevant regulations of the state and the school on the use of computer network and have not yet constituted a crime shall be punished according to the circumstances and the degree of harm as follows:

(1) Writing or spreading harmful information on the Internet, such as distortion of facts or insulting and defaming the character of others, obscenity, violence, etc., resulting in adverse effects, shall be punished with a demerit or probation;

(2) Those who intentionally create or spread computer viruses and other destructive programs to disrupt the normal operation of computer systems are given a serious warning or a demerit;

(3) The use of network media to create or spread confusing speech, disrupting the normal teaching and living order, depending on the severity of the circumstances, will be given a demerit or above;

(4) Those who endanger network security by stealing others’ IP addresses and user accounts through the network will be given a warning or a serious warning.

Article 15 International students who engage in fights, participate in brawls, provide murderous weapons, provoke trouble, or take sides in the name of persuasion shall be punished as follows, in addition to compensation for financial losses (if the person being beaten commits self-defense or emergency evasion, no punishment or lighter punishment shall be imposed according to the relevant national laws and regulations):

(1) Perpetrator(disorderly, disobedient, provocative with words, touching others in various ways). Those who do not hit others, but provoke trouble causing the consequences of a fight:

A. Serious warning or a demerit for those who do not injure others;

B. Causing minor injury to another person shall be punished with a demerit or probation;

C. Causing serious injury to another person shall be placed on probation or expelled from school.

(2) Organizers and planners. Although not hitting others, but causing consequences.

A. A demerit or probation for those who do not injure others;

B. A person who causes a minor injury to another person shall be placed on probation;

C. If the consequences are serious, the student will be expelled from school.

(3) Fighters:

A. A serious warning is given to a person who strikes another person but does not injure him/her.

B. A person who causes a minor injury to another person shall be punished with a demerit or probation.

C. A person who causes a serious injury to another person shall be punished by expulsion from school.

D. Those who beat people first, and those who beat people with weapons, bullying, intentional retaliation for assault and battery, shall be given an aggravated punishment of one level.

(4) Participants who, in the name of “persuasion” or otherwise, participate in a fight and contribute to the development of the situation shall be given a serious warning or a demerit.

(5) A person who provides a murder weapon to another person:

1. Those who dont cause any consequences will be given a demerit or probation.

2. Those who cause consequences will be placed on probation or expelled from school.

(6) The main members of a mass brawls and those who deliberately compel others, expand the situation or cause injury by armed brawl shall be punished with probation or more.

(7) Those who beat others with weapons and cause consequences shall be punished by expulsion from school.

(8) If a student is involved in a fight with someone who is not from the school, or if he or she gathers others to take revenge or provoke trouble after the fight, he or she will be placed on probation if the circumstances are minor and no one else is hurt; if he or she causes serious repercussions or injury, he or she will be expelled from the school.

Article 16 A person who possesses or carries knives restricted by the Chinese public security authorities shall be given a serious warning; if he/she causes consequences, he/she shall be punished with a demerit or above, depending on the severity of the circumstances.

Article 17 Anyone who takes, injects or participates in the illegal manufacture, trade or distribution of drugs or other prohibited drugs shall be put on probation or expelled from school, depending on the severity of the circumstances.

Article 18 International students who are absent from classes (including experimental and practical courses, internships and activities organized by the college that they are required to attend) within one semester and have accumulated the following academic hours shall be given the following treatment:

(1) 10 to 19 credit hours, warning; 

(2) 20 to 29 credit hours, serious warning;

(3) 30 to 39 credit hours, demerit;

(4) 40-59 credit hours, probation;

(5) If the total number of credit hours is 60 or more, the student may be withdrawn from the course;

(6) Those who have been placed on probation for absenteeism and still do not repent, and who continue to be absent from school during the probation period, and still reach the condition of warning or above, shall be expelled from school.

Three late arrivals or early departures will count as one missed lesson, and more than 15 minutes of late arrivals or early departures will count as absences.

Those who are absent from school for less than 10 hours but have a bad influence and a poor attitude towards admitting their mistakes will be notified and criticised, or even punished.

Those who have missed more than 1/3 of the total number of credit hours within an academic year will be automatically withdrawn from the school.

Article 19 International students who violate the rules and discipline of examinations shall be subject to disciplinary sanctions depending on the circumstances:

(1) A warning to a demerit shall be given for any of the following acts during an examination:

A. Bringing items other than those specified into the examination room or not placing them in the designated place;

B. Failing to take the examination at the prescribed seat;

C. Answering questions before the signal for the start of the exam or continuing to answer questions after the signal for the end of the exam has been given;

D. Peeping, whispering to each other, exchanging codes or gestures during the exam;

E. Making noise, smoking or committing other acts that affect the order of the examination room;

F. Leaving the examination room without the permission of the exam staff during the exam;

G. Taking the exam paper, answer sheet, draft paper or other paper out of the exam room;

H. Answering questions with a pen or paper other than those specified in the examination, or writing names or exam numbers in a place other than those specified in the examination regulation, or otherwise marking information on the answer sheets;

I. Violating the rules of the examination room but has not yet committed an act of cheating.

(2) A person who does any of the following during an examination shall be deemed to have cheated and shall be placed on probation.

A. Bringing the textual materials or electronic devices that store information related to the exam;

B. Carrying devices with the function of sending or receiving information;

C. Using communication equipment;

D. Copying or assisting others to copy the answers or materials related to the content of the exam;

E. Snatching or stealing other people's examination papers or answer sheets, or coercing others to provide convenience for their own plagiarism;

F. Passing and receiving objects or exchanging examination papers, answer sheets or draft papers;

G. Obtaining examination qualifications and results through falsification of documents, certificates, files and other materials;

H. Two or more answer scripts with identical correct answers in the same examination room for the same subject are found during the marking process;

I. Other acts that should be considered as cheating.

(3) Any person who does any of the following during an examination shall be deemed to have committed an egregious act of cheating with serious circumstances shall be expelled from the school:

1. Taking the exam in place of or taking the exam for others;

2. Organizing cheating, selling exam questions or answers to others for profit;

3. Cheating with communication equipment and other serious cheating behaviors.

Article 20 Academic misconduct such as plagiarism, falsification, or forgery of graduation thesis (graduation design) or publicly published research results shall be given a warning or above, and those with serious circumstances, or those who write papers on behalf of others, buy or sell papers, shall be given punishments of probation or above.

Article 21 If disciplinary actions not listed in these Regulations really need to be punished, they may be punished in accordance with similar provisions or other regulations formulated by the school.

Chapter  Enforcement Procedures and Discharge of Discipline Treatment

Article 22 When imposing disciplinary actions on international students, the students should be cautious, with clear facts, sufficient evidence, clear basis, accurate characterization, proper procedures, appropriate disciplinary actions and complete procedures.

Article 23 Management authority of disciplinary sanctions for international students

If an international student violates the regulations on dormitory management, the dormitory management teacher of the second-level school and the Student Affairs Office shall be responsible for investigating, collecting evidence, and making suggestions for handling;

International students who violate the Law of the People's Republic of China on Penalties for Administration of Public Security or commit other illegal and criminal acts shall be dealt with by the Security Office in accordance with the relevant regulations and in conjunction with the Student Affairs Office;

If an international student violates the regulations on academic registration, the Academic Affairs Office shall make suggestions for handling in conjunction with the Student Affairs Office in accordance with the relevant regulations;

For international students who cheat or violate examination discipline, the Academic Affairs Office, in conjunction with the second-level school shall make suggestions to the Student Affairs Office for handling;

Other disciplinary actions of international students will be investigated and evidenced by the student's second-level school in conjunction with relevant departments, and recommendations will be made to the Student Affairs Office for handling.

Article 24 Evidence taking and verification:

(1) If the international students violate discipline on campus, the school to which the students belong and the relevant units shall jointly investigate the disciplinary facts and form written materials.

(2) If the international students violate discipline outside the campus, the Security Office and the Student Affairs Office will contact the public security authorities to investigate the disciplinary facts and responsibilities and form written materials.

Article 25 Before making disciplinary or other unfavorable decisions on international students, the college will inform the international students of the facts, reasons and basis of the decisions, and inform them of their rights to make statements and arguments, listen to their statements and arguments, carefully make records, and collect relevant information, in accordance with the relevant provisions of the Regulations, objectively and accurately put forward handling opinions, report to the relevant departments within one week, and report to the president in charge for approval after review. When giving sanctions to international students, if the opinions of the relevant departments are not unanimous, it shall be reported to the president in charge for approval;

The decision of disqualification, cancellation, withdrawal, expulsion or other treatment or punishment involving students' significant interests for international students shall be discussed and decided by the President's Office meeting.

Article 26 The school shall issue a written decision on the punishment when imposing a sanction on a student. The written punishment decision shall include the following contents: (1) the basic information of the student; (2) the facts and evidence of the punishment; (3) the type, basis, and time limit of the punishment; (4) the channel and time limit for appeal; (5) other necessary content.

Article 27 The school shall directly serve the student himself or herself by issuing a disciplinary decision, notice of disciplinary, etc., and inform the student of the time limit within which he or she may submit an appeal. If the student refuses to sign for receipt, it may be served by lien, which will be recorded by the staff serving the disciplinary decision; If the student has left the school, it can be delivered by mail, and the date of receipt indicated on the receipt is the date of delivery; If it is difficult to contact, it can be served by means of an announcement using the school website, news media, etc., the announcement period is 20 days, and the expiration of the announcement period is deemed to be delivered.

Article 28 In addition to the punishment of expulsion from the school, the school shall set a period of 9 months for giving the international student a warning and a serious warning, and set a 12-month period for the punishment of demerit and probation for the international student, which shall be lifted in accordance with the procedures prescribed by the school. After the sanction is lifted, the international student receives commendations, awards and other rights and interests and is no longer affected by the original sanction.

Article 29 The school shall truthfully and completely classify the materials for rewarding, handling, punishing and lifting the punishment of international students into the school's document archives and personal files.

Article 30 International students who have objections to the disciplinary decision may, within 10 days from the date of receipt of the disciplinary decision, submit a written appeal to the school's Student Appeals Handling Committee in accordance with the provisions of the Jiangsu Urban and Rural Construction Vocational College Student Appeals Handling Measures. If no written appeal is submitted after the deadline, it is regarded as an automatic waiver.

Article 31 After the expiration of the punishment period, if the sanctioned international student has performed well in all aspects, the international student himself/herself may apply for revoking the sanction or terminating it in advance. Monitor or head teacher shall preside over the class appraisal (in principle, all the classes shall participate and more than two-thirds of them shall agree), and the second-level school shall put forward a recommendation on whether to revoke the sanction or terminate it in advance, according to his/her performance and class appraisal, and report the relevant materials to the Student Affairs Office for approval. If the punishment is lifted in advance, the actual period of punishment shall not be less than 6 months. The procedures for lifting the sanction are as follows:

(1) After being punished, the international student shall submit an ideological report of not less than 800 words every month, and the second-level school shall review the educational performance of the violating international student and report the review opinions to the Student Affairs Office at the end of the inspection period for approval and lift the sanction;

(2) If an international student who has been given a warning or a serious warning has a deep reflection on the mistakes during the period of punishment, and performs well and makes greater progress, upon his/her own application, review by his/her class and second-level school, he/she shall report to the Student Affairs Office for approval and lift the sanction after 9 months of punishment;

(3) The period for demerit and probation is 12 months, counting from the date on which the punishment is announced. International students who have been punished have a profound understanding of the nature, causes, and harmfulness of their violations of discipline during the punishment period, and have indeed shown repentance, and after being punished, they can consciously abide by laws and regulations, and codes of conduct, and there are no more other violations of discipline, then the punishment may be lifted on schedule upon appraisal; if they continue to violate discipline during the period of probation, they may be expelled from school;

(4) If an international student is placed on probation and cannot be released before graduation, the college will give him/her a certificate of completion. After the expiration of the probation period, upon his/her own application, his/her unit proves that he/she has performed well, the school may issue a new graduation certificate after reviewing that he/she meets the graduation requirements;

(5) International students who have been expelled from school shall be issued a certificate of study by the college. The international students should follow the relevant regulations of the school and leave within 10 days after receiving the notice.

Chapter Supplementary Provision

Article 32 The above and below mentioned in these provisions are those that include the numbers described or the level of punishment.

Article 33 If disciplinary actions not listed in these provisions should be punished, they can be punished by referring to the most similar provisions.

Article 34 The second-level schools and departments shall implement these provisions seriously, and all international students shall study these provisions and actively participate in the supervision, and have the right to report the international students who violate the discipline or the staff who do not implement these provisions .

Article 35 The disciplinary materials for International Students shall be truly and completely included in their own files by the Student Affairs Office.

Article 36 The Student Affairs Office shall be responsible for the interpretation of these provisions.

Article 37 These provisions take effect on the date of promulgation.
